Terms of Use

These Terms of Use (the "Terms") govern access to and use of the Drillz mobile application (the "App" or "Drillz"). By creating an account and using the App, you acknowledge that you have read, understood and unreservedly accepted these Terms. If you do not accept these Terms, you must stop using the App.

1. Purpose of the service

Drillz is a mobile application that connects athletes who want to train together. The App notably lets you:

• create and join sports events;
• post and respond to "drill requests" (location-based training requests);
• discover "spots" (training locations);
• create and browse sports profiles;
• chat through the built-in messaging, and report or block other users.

Drillz acts solely as a technical intermediary that facilitates connections between users. Drillz does not organize training sessions, does not supervise meetings and is not a party to the relationships formed between users.

2. Registration conditions

• Use of Drillz is reserved for people aged 16 or over. Minors under 18 declare that they have the authorization of their legal guardians.
• Each user undertakes to provide accurate, up-to-date and truthful information when registering.
• Only one account is allowed per person. Creating multiple or fraudulent accounts is prohibited.
• The user is solely responsible for keeping their login credentials confidential and for all activity carried out from their account.

3. Expected user behavior

Each user undertakes to:

• behave respectfully, courteously and considerately toward other users;
• not post any unlawful, violent, hateful, defamatory, sexual, discriminatory content, or content contrary to public order and public decency;
• not harass, threaten, impersonate others, or solicit other users for unauthorized commercial purposes;
• respect training locations (spots), venue rules and other athletes.

4. Safety during in-person meetings

Drillz facilitates meetings that may take place in the real world. The user acknowledges that such meetings involve inherent risks and undertakes to exercise caution. In particular, it is recommended to:

• favor public, busy places for a first meeting;
• tell someone close to you the location, time and who you are meeting;
• not share sensitive personal information prematurely;
• end any meeting if in doubt and report any suspicious behavior.

5. User responsibility during training

The user takes part in training sessions and sports activities under their own sole and full responsibility. It is up to them to make sure they are in good physical condition and fit to practice the activity concerned, where appropriate after seeking medical advice. Drillz cannot be held liable for injuries, bodily or material damage, accidents or any harm occurring in connection with a training session, an event or a meeting organized through the App.

6. Moderation and reporting

Drillz enforces a zero-tolerance policy toward objectionable content and abusive behavior. No unlawful, hateful, violent, harassing content, or content contrary to these Terms, is tolerated on the App.

The App provides reporting and blocking tools that let each user report inappropriate content or behavior and block another user. Drillz commits to reviewing every report and removing any objectionable content, as well as restricting or ejecting the user who posted it, within 24 hours of the report.

7. Account suspension and deletion

• Drillz reserves the right to suspend or delete any account in the event of non-compliance with these Terms, inappropriate behavior, repeated reports or fraudulent activity.
• The user may delete their account at any time from within the App. Deletion results in the anonymization of the associated data in accordance with the Privacy Policy.

8. Limitation of Drillz's liability

Drillz strives to ensure the availability and proper functioning of the App but cannot guarantee it on an uninterrupted basis. Drillz cannot be held liable for:

• content posted by users or the accuracy of the information shown on profiles;
• the behavior, failings or disputes between users;
• interruptions, technical malfunctions or data losses beyond its control.

In the event of a dispute between users, Drillz is not a party to the relationship but may, at its sole discretion, act as a mediator.

9. Changes to the Terms

Drillz reserves the right to amend these Terms at any time. Users will be informed of any substantial change. Continued use of the App after an update constitutes acceptance of the new Terms.

10. Governing law

These Terms are governed by French law. Failing an amicable resolution, any dispute relating to their interpretation or performance will be submitted to the competent French courts.
